(Here in after known as Cape Villas)

WHEREAS:

1. The LANDLORD owns the premises known as _____________________

2. Cape Villas, will exclusively manage the premises together with all its fixtures and fittings for the purposes of letting the property as business, holiday accommodation & for use by the film and media industries, on a commission basis.


3. The mandate shall commence on _______________ and shall terminate twenty four (24) months thereafter ("the initial period"). A four month cancellation period is required should the Landlord wish not to be a part of the “Cape Villas Exclusive Collection” or wish another agent to represent the property. Any bookings made by Cape Villas that extend past this four month period must be honored. Unless in circumstances of property sale. (See 4)

4. If the property is sold, Cape Villas will endeavor to move any future bookings to an alternate property, we have to date been 100% successful at this in the past offering an incentive such as a 20% price reduction, we expect the price reduction offered to the client to be paid for by the Landlord, but will only make such offers with permission of the landlord.

5. Cape Villas will perform two functions

a. Property Management, which includes
i. Inventory of property to be checked before and after guests stay.
ii. Maid Servicing.
iii. Meet and greet hostesses inspect villa before during and after guests arrival.
iv. Hospitality management with visit all guests at least once at the property.
v. Cape Villas maintenance staff handyman, plumber and electrician will regally inspect the premises.
vi. Appointment of a house servant/manager who will be responsible for no more than two nearby properties.
vii. Providing of all cleaning materials, pool chemicals, fertilizers etc.
viii. Providing of all guest soaps, sundries and gifts.


b. Property Marketing, which includes.

i. Professional photo shoot.
ii. Dedicated photo card to be displayed in both our Shop windows.
iii. Placement on the front page of our web site.
iv. Placement onto various on other pay inclusion web sites web sites.
v. Priority rental for Cape Villas Sales staff, your property will be offered if suitable as an alternative to any non exclusive villa requested.
vi. Cape Villas exclusive properties will feature above non exclusive properties in our real time search facility.
vii. Cape Villas properties will appear at the top of our natural listings.
viii. Offer of Inclusion of any special marketing opportunities that Cape Villas consider. i.e. inclusion in the Portfolio Collection, DSTV Competition, Luxury Retreats magazine.
ix. Cape Villas will offer the property for test shoots to photographers, with the condition that we will have the right to use any photographs taken for our own marketing purposes.
x. As a Cape Villas managed property we are sure of excellent customer service and so Cape Villas will raise the “Nick Ball Grading” (one to six star.) by ½ a star compared to a non Cape Villas managed property.

6. The Landlord will pay for all property consumables, such as electricity, water rates, refuge collection, gas, ADSL, DSTV, etc.

7. Cape Villas will charge a 20%+ VAT commission for sales and marketing. An additional 10% + VAT will be charged for property management and consumables.

8. Cape Villas will pay the landlord on a monthly basis, within one month of the end of the month that the money for a booking is received by Cape Villas. Into the LANDLORD'S Nominated Bank account,

9. Cape Villas promises it will make all houses in there exclusive collection there No, 1 priority and by using a price vs. occupancy business model . Endeavor to make you the best possible return on your property.

10. Cape Villas will for every rental hold a R10, 000 breakages deposit.

11. Cape Villas will be paid in advance for every booking.
